1. The service

FIVE ART is an online marketplace connecting artists and collectors for the sale of original artworks. Acting as an intermediary, FIVE ART is not the direct seller of the works: the transaction takes place between the buyer and the artist, with FIVE ART retaining a commission of 15% on each sale.

2. Registration

To make a purchase you must create an account. You are responsible for the confidentiality of your credentials. You must be at least 18 years old to register and purchase.

3. Purchases & payments

Prices are expressed in Euros (€) and include VAT where applicable. Payments are processed securely via Stripe. All works are originals certified by the artist. Once a purchase is confirmed, the work is reserved for the buyer and is no longer available to other users. The sale is considered final upon payment confirmation.

4. Shipping

The artist is responsible for packaging and shipping within 3 business days of order confirmation. Shipping costs are calculated at checkout based on destination. FIVE ART is not responsible for delays caused by the courier. All shipments include basic insurance for loss or damage in transit.

5. Returns & refunds

All works sold on FIVE ART are unique, original artworks. As such, they fall under the exclusions to the right of withdrawal provided by Art. 59, paragraph 1(c) of Legislative Decree 206/2005 (Consumer Code), which applies to goods made to the consumer's specifications or clearly personalised.

Returns are accepted exclusively in the following cases:

• The artwork arrives visibly damaged due to shipping
• The artwork received does not correspond to what was described on the listing

To request a return under the above conditions, contact us at fiveart.ronchini@gmail.com within 48 hours of receiving the work, with photographic evidence. FIVE ART will assess each case individually. If the return is approved, the refund will be issued within 14 days of receiving the returned work in its original condition.

No returns are accepted for change of mind, personal preference, or any reason other than those listed above. By completing the purchase, the buyer acknowledges and accepts this policy.

6. Intellectual property

The purchase of a physical artwork does not transfer copyright to the buyer. The artist retains all rights of reproduction, publication and distribution of the image of the work, unless separate written agreements are made.

7. For artists

Artists agree to publish only original works of their own intellectual property. FIVE ART reserves the right to remove works that infringe third-party rights or community guidelines. A commission of 15% is automatically retained on each sale via Stripe. Artists are responsible for the accuracy of their listings, including title, dimensions, medium, and year of creation.

8. For gallery partners

Galleries approved as FIVE ART partners agree to the following additional terms:

• A commission of 15% (or the rate agreed at onboarding) is retained on every sale made through the FIVE ART platform. No monthly fee is charged.
• Gallery partners are responsible for the accuracy of all artist profiles, exhibition listings, and artwork descriptions published under their account.
• FIVE ART reserves the right to remove gallery profiles or listings that do not meet editorial or quality standards, without prior notice.
• Gallery partner status may be revoked at any time by either party with 30 days' written notice. Existing orders at the time of termination will be fulfilled under the original terms.
• By applying and being approved as a partner, the gallery accepts these terms in full.

9. Limitation of liability

FIVE ART is not responsible for indirect damages, loss of profit or consequential damages arising from use of the site. Our maximum liability is limited to the amount of the order in question.

10. Applicable law

These Terms are governed by Italian law. For any dispute, the Court of Milan shall have jurisdiction, except where mandatory consumer protection provisions apply.
